General

1. The promoter is Pharmacy Services Co. Pty Ltd ABN 75 647 701 666, of Unit 5, 4 Brunker
Road, Chullora NSW 2190 (“Pharmacy 4 Less”)
2. Information on how to enter and prizes forms part of the terms of entry. Entry into the
competition is deemed acceptance of these Terms and Conditions.
3. If there is any inconsistency between these Terms and Conditions and anything else that
refers to this competition, these Terms and Conditions will prevail.

Who Can Enter
4. Entry is open to Australian residents aged 18 years and older except to residents of South
Australia, Australian Capital Territory and Northern Territory, employees and immediate
families of Pharmacy 4 Less and their associated companies and agencies. Immediate family
includes the following: spouse, ex-spouse, defacto spouse, child or step child (whether
natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt,
niece, nephew, brother, sister, step brother, step sister or first cousin.
5. Pharmacy 4 Less reserves the right to request winners to provide proof of identity, proof of
residency at the nominated prize delivery address and/or proof of entry validity or proof of
registration ownership in order to claim a prize. Proof of identification, residency and entry
considered suitable for verification is at the discretion of Pharmacy 4 Less. In the event that
a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no
substitute will be offered.

How to Enter
6. To enter eligible entrants must have a minimum spend of $50 at any Pharmacy 4 Less store
from the 6th September 2023 till the 1
st October 2023 and retain their receipt as proof of
purchase.
7. Entrants can enter multiple times, but only unique entries will be accepted.
8. The entrant must then go to the Pharmacy 4 Less website
(https://www.pharmacy4less.com.au/win) (or Scan the QR code instore) and register for the
Prize entry by completing the entry form which will require the entrant to provide their first
name, last name, email, address, date of birth, phone number, receipt number and answer
the following question “Which brand was rated by Australians as the top brand in the 2023
Canstar Blue's latest pharmacy ratings? to complete the entry. The cost of accessing the
promotional website will be dependent on the entrant’s individual Internet Service Provider.
9. Entrants are required to take full responsibility for the content of their entry form they
submit via the promotion including but not limited to comments, recordings and images
(“Content”) and must ensure that their entry complies with these Terms and Conditions and
information provided is correct. Pharmacy 4 Less shall not be liable in any way for such
Content to the full extent permitted by law. Pharmacy 4 Less may remove or decline to
publish any Content without notice for any reason whatsoever. Entrants warrant and agree
that:
(i) they will not submit any Content that is unlawful or fraudulent, or that Pharmacy 4
Less may deem in breach of any intellectual property, privacy, publicity or other
rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate,
violent, abusive, harassing, threatening, objectionable with respect to race, religion,
origin or gender, not suitable for children aged under 15, or otherwise unsuitable for
publication;
(ii) their Content shall not contain viruses or cause injury or harm to any person or
entity;
(iii) they will obtain prior consent from any person or from the owner(s) of any property
that appears in their Content;
(iv) the Content is the original literary work of the entrant that does not infringe the
rights of any third party;
(v) they consent to any use of the Content which may otherwise infringe the Content
creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and
warrant that they have the full authority to grant these rights; and
(vi) they will comply with all applicable laws and regulations, including without
limitation, those governing copyright, content, defamation, privacy, publicity and
the access or use of others’ computer or communication systems.
10. Without limiting any other terms herein, the entrant agrees to indemnify Pharmacy 4 Less
for any breach of the above terms.
11. As a condition of entering this promotion, each entrant licenses and grants the Pharmacy 4
Less, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide,
irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display
their entry (which shall include Content) for any purpose, including but not limited to future
promotional, marketing or publicity purposes, in any media, without compensation,
restriction on use, attribution or liability.
12. Entrants consent to Pharmacy 4 Less using their name, likeness, image and/or voice in the
event they are a winner (including photograph, film and/or recording of the same) in any
media for an unlimited period without remuneration for the purpose of promoting this
promotion (including any outcome), and promoting any products manufactured, distributed
and/or supplied by Pharmacy 4 Less.
13. Pharmacy 4 Less reserves the right to disqualify any entrant who tampers with the entry
process, who submits an entry that is not in accordance with these Terms and Conditions or
who has, in the opinion of Pharmacy 4 Less, engaged in conduct in entering the Promotion
which is fraudulent, misleading, deceptive or generally damaging to the goodwill or
reputation of the Promotion and/or Pharmacy 4 Less. This includes, but not limited, to
entrants and households using multiple email addresses, postal addresses, PO Box addresses
or SIM cards to register single purchases. 

When to Enter
14. The competition commences on 6 September 2023 and entries close midnight on 1 October
2023. Entries must be received by Pharmacy 4 Less prior to the competition close date and
time.
15. The time of entry will in each case be the time the online entry is completed and registered
with Pharmacy 4 Less, not at the time of the transaction by the entrant.
16. Pharmacy 4 Less accepts no responsibility for any late, lost or misdirected entries including
not received entries by Pharmacy 4 Less or delays in the registration process due to technical
disruptions, network congestion or for any other reason. 

Prize on offer
17. The winners will receive one of the following $250 Pharmacy 4 Less Gift Card or $500
Pharmacy 4 Less Gift Card, the total prize pool is $10,000 in Pharmacy 4 Less Gift Cards (10 x
$500 + 20 x $250 Pharmacy 4 Less Gift Cards)
18. The prize cannot be transferred, exchanged or redeemed for cash.
19. The Pharmacy 4 Less Gift Card can be spent at the discretion of the announced winner.
20. It is a condition of accepting the prize that the winner may be required to sign a legal release
and/or indemnity in a form determined by Pharmacy 4 Less in its absolute discretion.
21. Pharmacy 4 Less is not responsible for any acts of god, such as adverse weather conditions
or industrial action or civil commotion that may take place. The winner must make his or her
own enquiries about local issues and conditions at destinations prior to travel.

Judging and Notification of Winner
22. The judging will take place at Pharmacy 4 Less’s head office located at Unit 5, 4 Brunker road
Chullora NSW 2190, on 18th October 2023 at 12:00pm.
23. The judges may select additional reserve entries, which they determine to be the next best,
and record them in order, in case of an invalid entry or ineligible entrant. This is a game of
skill and chance plays no part in determining the winners. Each entry will be individually
judged based on literary and creative merit of the answer provided to the promotional
question.
24. Pharmacy 4 Less’s decision is final and Pharmacy 4 Less will not enter into correspondence
regarding the competition result or any other decisions Pharmacy 4 Less makes in
connection with the Promotion.
25. The winner’s name will be announced daily on Facebook from 19th of October to 28th
October. Winners to reach out via Facebook Messenger, winners have till 16th October to
claim prize via Facebook Messenger.
26. The prizes will be awarded to the person named in the entry.
27. Should an entrant’s contact details change during the promotional period, it is the entrant's
responsibility to notify Pharmacy 4 Less. A request to access or modify any information
provided in an entry should be directed to the Pharmacy 4 Less.
28. Pharmacy 4 Less reserves the right to redraw the prize if an entrant who claims to be a prize
winner is unable to satisfy these Terms and Conditions. Subject to State Regulation, an
unclaimed prize draw will take place at Unit 5, 4 Brunker Road, Chullora NSW 2190 on 17
October 2023 at 12:00pm. The winner of the unclaimed prize draw will be notified by
telephone or email within two days of that draw.
29. Pharmacy 4 Less will make reasonable efforts to deliver prize to the address provided by
competition entrants. If a prize is returned to Pharmacy 4 Less because it could not be
delivered to the address provided, Pharmacy 4 Less cannot guarantee that it will be able to
resend the prize to the prize winner. Pharmacy 4 Less and its associated agencies and
companies will not be liable for any loss, damage to or delay in transit of prizes.

Further Terms and Conditions
30. By entering this competition, entrants accept and acknowledge full responsibility for their
decision to participate in this prize should they be chosen as winners. The winners release
the Pharmacy 4 Less and other organisers, their related bodies corporate, affiliates, officers,
agents and employees, from all liabilities, loss and damage of any kind arising at any time
out of or in connection with the acceptance of, and participation in, the prize.
31. Subject to complying with all relevant State legislation, the Pharmacy 4 Less reserves the
right to amend, cancel or suspend this competition if an event beyond the control of
Pharmacy 4 Less corrupts or affect the administration security, fairness, integrity or proper
conduct of the competition.
32. If the prize is unavailable, for whatever reason, Pharmacy 4 Less reserves the right to
substitute the prize for a prize of equal or greater value, subject to State and Territory
legislation. Each prize must be taken as stated and no compensation will be payable if a
winner is unable to use the prize as stated.
33. Pharmacy 4 Less collects personal information about you for the purposes of conducting this
promotion. Any disclosure of such information will be made as required by law and in
accordance with these Terms and Conditions, but no further use of this information will be
made without prior consent.

34. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit,
exclude or modify the statutory consumer guarantees as provided under the Competition
and Consumer Act, as well as any other implied warranties under the ASIC Act or similar
consumer protection laws in the States and Territories of Australia. Except for any liability
that cannot by law be excluded, including the Non-Excludable Guarantees, Pharmacy 4 Less
(including its respective officers, employees and agents) excludes all liability (including
negligence), for any personal injury; or any loss or damage (including loss of opportunity);
whether direct, indirect, special or consequential, arising in any way out of the promotion.
35. Except for any liability that cannot by law be excluded, including the Non-Excludable
Guarantees, Pharmacy 4 Less (including its respective officers, employees and agents) is not
responsible for and excludes all liability (including negligence), for any personal injury; or any
loss or damage (including loss of opportunity); whether direct, indirect, special or
consequential, arising in any way out of:
a. any technical difficulties or equipment malfunction (whether or not under Pharmacy
4 Less’s control);
b. any theft, unauthorised access or third party interference;
c. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether
or not after their receipt by Pharmacy 4 Less) due to any reason beyond the
reasonable control of Pharmacy 4 Less;
d. any variation in prize value to that stated in these Terms and Conditions;
e. if any organized tour or activity is delayed, postponed or cancelled for any reason
beyond the reasonable control of Pharmacy 4 Less;
f. any tax liability incurred by a winner or entrant; or
g. taking of a prize, participation in a prize and/or use of a prize.
36. Pharmacy 4 Less (including its respective officers, employees and agents) and associated
companies assume no responsibility for any error, omission, interruption, deletion, defect,
delay in operation or transmission, communications line failure, theft or destruction or
unauthorized access to, or alteration of entries, and reserves the right to take any action
that may be available, subject to state government legislation.
37. Pharmacy 4 Less (including its respective officers, employees and agents) and associated
companies will not be liable for any misadventure, error, accident, injury, loss (including but
not limited to consequential loss) or claim that may occur:
a. during the judging;
b. in the acceptance, participation or use of any element(s) of the prize;
c. as a consequence of late, lost or misdirected mail;
d. due to the broadcast or the publication of any material, including any statements
made by any staff member, journalist, other entrants or any other person including
but not limited to any error in the announcement of the potential winners; or
e. arising from or related to any problem or technical malfunction of any telephone
network or lines or mobile communications network related to or resulting from
participation in this promotion.
38. These Terms and Conditions and this competition are governed by, and construed in
accordance with, the Laws of New South Wales and the entrants submit to the exclusive
jurisdiction of New South Wales courts and any courts which have jurisdiction to hear
appeals from any of those courts.
